By creating an account or using NightSage, you agree to these Terms of Use. If you do not agree, do not use the service. These terms form a binding agreement between you and the operator of NightSage.

NightSage is an AI-powered dream journal that provides AI-generated dream analysis for personal, informational, and entertainment purposes. The service is operated by an individual developer based in Croatia.

We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of the service.

NightSage is a self-reflection and journaling tool. It does not provide medical, psychological, psychiatric, or predictive advice, and should not be relied upon as a substitute for professional mental health care. AI-generated insights are intended for personal reflection and entertainment purposes only.

Important: the dream analysis provided by NightSage is generated by artificial intelligence and is for entertainment and personal reflection purposes only. It does not constitute medical, psychological, psychiatric, or therapeutic advice of any kind.

Do not use NightSage as a substitute for professional mental health care. If you are experiencing psychological distress, please consult a qualified mental health professional.

You must be at least 16 years old to use NightSage. By creating an account you confirm you meet this requirement.

• —You are responsible for maintaining the security of your account and password.
• —You are responsible for all activity that occurs under your account.
• —You must provide accurate information when creating your account.
• —You may not share your account with others or create multiple accounts to circumvent limits.

You agree not to use NightSage to:

• —Submit content that is illegal, harmful, abusive, or violates any applicable law.
• —Attempt to bypass or circumvent plan limits.
• —Use automated tools, bots, or scripts to access the service.
• —Attempt to probe, scan, or test the vulnerability of our systems.
• —Reverse engineer, decompile, or otherwise attempt to extract source code from the service.

We reserve the right to suspend or permanently terminate accounts that violate these terms without prior notice.

• —Premium subscriptions are billed monthly or annually and renew automatically until cancelled.
• —Features described as "unlimited" are subject to fair use. We may rate-limit accounts whose usage patterns are inconsistent with personal use, such as automated or scripted activity.
• —You may cancel at any time through the billing portal. Access continues until the end of the current billing period.
• —Payments are processed by LemonSqueezy, the Merchant of Record, and are subject to their terms.
• —Refunds are handled at our discretion. If you believe you were charged in error, contact us within 14 days.
• —We reserve the right to change pricing with at least 30 days notice to existing subscribers.

You retain ownership of the dream content you submit. By submitting content, you grant us a limited licence to process and store it for the purpose of providing the service — including sending it to OpenAI's API to generate your analysis.

We do not claim ownership of your dreams or their analysis. You may delete your content at any time by deleting dreams from your account or closing your account entirely.

If you choose to make a dream publicly accessible via a share link, you accept that anyone with the link can view that analysis. You can revoke access at any time by making the dream private, which generates a new link for future shares.

Do not share dreams containing sensitive personal information you would not want publicly visible.

NightSage is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that the analysis will be accurate, meaningful, or useful for any particular purpose.

AI-generated content may be incorrect, inconsistent, or unexpected. Use it accordingly.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service — including but not limited to decisions made based on AI-generated dream analysis.

Our total liability to you for any claim arising from use of the service shall not exceed the amount you paid us in the 3 months preceding the claim.

These terms are governed by the laws of the Republic of Croatia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Croatia, unless mandatory consumer protection laws in your country of residence provide otherwise.

We may update these terms from time to time. We will notify you by email at least 14 days before significant changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
